US Patent Law Reform has Arrived

The final form of US Patent Law reform legislation (in the form of the “America Invents Act”) has now been enacted. On September 8, 2011, the Senate voted to adopt the bill that had been passed by the House of Representatives on June 23, 2011 (HR 1249) and on September 16, 2011, the President signed it. The main features of the new law will, for the most part, take effect one year after enactment. However, a few provisions come into effect immediately, or almost immediately, and others only eighteen months after enactment. New official fees come into force 10 days from enactment. Comments on the US White Paper on IP Enforcement

The Obama administration has issued a white paper entitled “Intellectual Property Enforcement Legislative Recommendations” on the domestic enforcement of Intellectual Property (IP) rights, which proposes increasing criminal penalties for distributing counterfeit drugs, economic espionage and the theft of trade secrets and the creation of a right of public performance for sound recordings transmitted by over-the-air broadcast stations. John Richards of our New York Office has written a thought provoking article, recently published by Intellectual Property Magazine, about the extent to which these proposals might be accepted or rejected by American public opinion.
