In
this Guide we
[1]
will address two aspects of European patent law and practice. In particular, we
will deal with the European Patent Convention and other aspects of European
patent law, including the effects of the Treaty of Rome on the enforcement of
patents and other intellectual property rights in the European Community. In
this Guide we can do no more than highlight the major issues that have
developed as attempts have been made to create a multinational, continent-wide
patent system over the past fifteen years or so. Not every issue can be covered
and even for those issues that are covered this guide can do no more than
provide first aid for colleagues when confronted with a particular issue.
The
contents of this paper are no substitute for proper legal advice on any
particular problem, but we hope they will be helpful in a general way in
assisting readers in focusing on the issues involved. While we believe that
the information set out is accurate as of the date of writing, we cannot be
held liable for any errors that may have occurred.
