Professional Profile

Robert Alpert is a Partner at Ladas & Parry LLP. He specializes in intellectual property dispute resolution and is in charge of the Litigation Department in the New York Office. Mr. Alpert is admitted in numerous Federal Courts, including the United States Supreme Court, and has litigated in all areas of intellectual property law, including unfair competition, trademark, copyright and patent law as well as such related areas of the law as the rights of publicity and privacy. He has litigated in state and federal courts throughout the United States as well as before various administrative agencies, including the U.S. Patent and Trademark Office, the International Trade Commission and ICANN.

Reported decisions include:

• Christopher Norman Chocolates, Ltd. v. Schokinag Chocolate North America, Inc., 270 F. Supp. 2d 432 (S.D.N.Y. 2003) (successfully opposed plaintiff’s motion for a preliminary injunction following termination of joint venture);

• Manufacture des Montres Jaguar, S.A. v. Jaguar Cars Litd., 2000 U.S. Dist. LEXIS 13731 (S.D.N.Y. 2000) (successfully opposed defendant’s motion to dismiss, transfer or stay action in favor of prior-filed suit in Michigan);

• Mondo, Inc. v. Sirco Intl. Corp., 1998 U.S. Dist. LEXIS 18996 (S.D.N.Y. 1998) (successfully opposed plaintiff’s motion for summary judgment and convinced court to grant, sua sponte, summary judgment in favor of client);

• Virgin Air, Inc. v. Virgin Atlantic Airways Ltd., 144 F.R.D. 56 (N.D. Ill. 1992) (successfully opposed plaintiff’s motion to disqualify client’s counsel in the Virgin Islands);

• Yoo-Hoo Chocolate Beverage Corp. v. A.J. Canfield Co., 229 U.S.P.Q. 653 (D.N.J. 1986) (successfully opposed plaintiff’s motion for preliminary injunction);

• Vitabiotics, Ltd. v. Krupka, 606 F.Supp. 779 (E.D.N.Y. 1984) (successfully moved for summary judgment against certain defendants and obtained injunction, destruction order and award of attorney fees);

• Ann-Margret v. High Society Magazine, Inc., 498 F.Supp. 401 (S.D.N.Y. 1980) (successfully moved for summary judgment dismissing plaintiff’s claims for violation of right of publicity);

• Chesa Intl., Ltd. v. Fashion Associates, Inc., 425 F.Supp. 234 (S.D.N.Y. 1977), aff’d, 573 F.2d 1288 (2d Cir. 1977) (successfully moved to confirm special master’s report awarding damages, sanctions and attorneys fees for infringement of client’s mark).

Mr. Alpert is a member of the American Bar Association and has written on trademarks, copyrights and patents for numerous intellectual property publications. He received his undergraduate degree from Yale College and his law degree from New York University School of Law. He also has been awarded a Masters of Fine Arts (Cinema) from Columbia University.
