Ukraine has enacted legislation providing for the extension of patents relating to pharmaceutical products to compensate the patent owner for the period during which marketing of the patented product had to be delayed while awaiting marketing approval from the government. The extension will be for the entire period between the filing of the patent application and the grant of marketing approval, but is subject to a maximum extension of five years. An application for extension can be filed at any time up to six months prior to the normal expiration date of the patent.
