Taiwan - Copyright Law Amendments

The Taiwan Copyright Law was amended with effect from July 11, 2003. Some of the major changes are set out below.

1. The rights of a copyright owner have been amended to make it clear that making a work in which copyright protection exists available on-line requires the consent of the copyright owner.

2. Rights relating to distribution of works that are protected by copyright are clarified to make it clear that the copyright owner has a distribution right but that this does not extend to control of the resale of such a work by someone who lawfully obtained an authorized copy of the work.

3. A right to payment for public performances of recorded works is introduced.

4. It is made an offense, subject to fines or imprisonment, to delete or alter electronic rights management information incorporated in copies of a copyrighted work.

5. The maximum fines for copyright infringement are increased.
