Saudi Arabia - New Trademark Law

A new trademark law has gone into effect in Saudi Arabia. The principal features of the new law are outlined below:

1. The definition of a trademark includes any distinguishable visible sign but does not provide for sound or smell marks;

2. Registrations may be renewed belatedly within six months of their expiration subject to payment of additional fees;

3. Oppositions are now filed before the Board of Grievances, which is the court of first instance, within ninety days following publication;

4. Refusals of trademarks can be appealed to the Minister of Commerce within sixty days from refusal. Further appeals can be filed before the Board of Grievances;

5. There have been substantial increases in the penalties for trademark infringement and the procedures for seizing infringing goods have been enhanced.
