Russian Federation - New Code of Administrative Offenses

A Russian Code of Administrative Offenses ("Code"), which came into force on July 1, 2002, creates new administrative penalties in various areas, including trademark infringement, i.e., fines and confiscation of the relevant infringing goods. The Code provides that fines may be levied against both a company and its officers (in their individual capacities), and sets forth a schedule of fines covering individuals, officers and legal entities.

The Code allows trademark owners to seize property bearing illegally reproduced trademarks, and thus extends the remedy under the present trademark law which was limited to the removal of the infringing mark from the goods.

In general, the Code at least theoretically, enhances the remedies available under Russian trademark law.
