Paraguay - Sound Mark Protection The Paraguayan Industrial Property Office has granted its first registration for a sound mark.
The Paraguayan Trademark Law defines a trademark as any "sign" that serves to distinguish products or services, but does not specifically mention sound as a type of mark. The Examiner had to consult an expert witness before granting the sound mark.
The importance of the decision lies in the fact that the Industrial Property Office thereby broadened the scope of the word "sign" used in Article 1 of the Trademark Law to include sound marks. By doing so, the Office established a new form of protection which is not clearly provided for in the Paraguayan Trademark Law.
