Kazakhstan - New Intellectual Property Customs Regulations

Kazakhstan significantly amended its customs regulations regarding goods “containing objects of intellectual property” allowing for th expedited seizure and disposal of counterfeit items. This law has been implemented subsequently by the introduction of a “Register of the Goods Containing Intellectual Property Items of the Republican Customs Committee.”

The Under the new procedures, the owner of an intellectual property right may record such right on the Register. The Customs authorities are authorized to seize goods then promptly notify the intellectual property owner and the owner of the seized goods. The seized goods will be released unless the intellectual property owner timely brings suit in criminal court proceedings.
