Malaysia - Patent Law Amendments

A number of amendments have been made to the Malaysian Patent Law. The main changes are set out below.

(1) For patents granted on applications filed after August 1, 2001, the maximum term of protection as long as renewal fees are paid will be twenty years from the filing date instead of fifteen years from grant as was the position hitherto.

(2) For utility certificates, the initial term of protection for those issued on applications filed after August 1, 2001 will be ten years, which term will be subject to two possible extensions of five years each.

(3) It has been made explicit that it is not a patent infringement to deal in patented products or the products of a patented process if these products are produced anywhere in the world by or with the consent, conditional or otherwise, of the patent owner or his licensee.
