Kyrgyzstan - Protection of Well-Known Marks The Government has adopted a decree to provide for the protection of well-known marks. Well-known marks are defined as those marks that gain notoriety due to, inter alia, a high degree of inherent distinctiveness, or extensive use or advertisement, either in Kyrgyzstan or in the world market, and that render a mark "characteristic of the goods or services of a definite manufacturer". Owners of eligible well-known marks may file applications, supported by information and documentation sufficient to establish the well-known nature of the marks, to register marks in a separate Register of Well-Known Marks. Owners of registered well-known trademarks may prevent use or registration of similar trademarks not only in respect of those goods or services for which the marks have become well-known, but also in respect of any other goods or services. |
