Jersey - New Trade Marks Law We have been advised that the Trade Marks (Jersey) Law 2000 became operative in October 2000. Although the law provides, as previously, that trademark owners may deposit their United Kingdom trademark registrations in Jersey in order to have effect there, the law introduces automatic protection in Jersey for European Community Trademark registrations and for International Registrations which have been extended to the territory of the United Kingdom in accordance with the Madrid Protocol. The law also amends the definition of a trademark to be consistent with the current definition under the United Kingdom Trademarks Act, and contains additional provisions relating to the unauthorized use of trademarks, including the ability to seize infringing products. |
