Indonesia - New Design Law

Hitherto there has been no design law in Indonesia, although some protection by way of copyright or "simple" patents has been available in some cases. Indonesia has now enacted a design law which came into effect on June 14, 2001. Its main provisions are set out below.

(1) Protection is available designs relating to form, configuration, compositions of lines and/or colors or dimensions which have give an aesthetic impression and are applied to products or goods. The designs may be two or three dimensional.

(2) Novelty is apparently to be judged on an absolute basis subject to a six month grace period for disclosure at a formal national or international exhibition or disclosure in Indonesia for the purpose of research, education or development.

(3) Protection will be for a single ten year period starting from the date of filing the application.

(4) Applications will be subject to a formality examination after which they will be published for opposition. If an opposition is filed there will then be a substantive examination. Otherwise the application will proceed to issue without substantive examination.
