Estonia - New Geographical Indications Protection Act

A new law has entered into force in Estonia which provides for the protection of geographical indications for an unspecified term. The Act defines geographical indications, the forms such indications may take (i.e. in word or design form) and the registration requirements and includes the following provisions:

i. the user of a geographical indication may add the letter "G" or the words "Registered geographical indication" to give notice that it is registered;

ii. the law has specific provisions relating to the use of registered geographical indications in respect of alcoholic beverages;

iii. there are various limitations affecting rights provided for in the Act; these include the refusal of protection for geographical indications that are misleading or have become generic;

iv. trademarks registered or applied for in good faith prior to the commencement of the new law, and which contain a geographical indication or are similar to one, shall not be barred from protection; and

v. disputes relating to geographical indications are handled by the Court and violations of the Act are punishable by fines.
