Netherlands - Protection for Sound Mark Refused Under Benelux Trademark Law by Appellate Court

In the first Dutch case involving sound marks, the appellate court in the Hague has ruled that Benelux trademark law does not permit their registration.

Benelux trademark law is therefore inconsistent with European Community law which expressly provides for the protection of sound marks under the Community Trademark Regulation. We understand that this decision is being appealed to the Supreme Court.
