Kazakhstan - New Trademark Law On September 3, 1999, a new law on trademarks, service marks and appellations of origin entered into force in Kazakhstan. In addition to containing a number of procedural changes, the following new provisions are of interest: 1) marks consisting solely of a single color are considered non-distinctive and unregistrable; 2) a combination of letters or numbers, not forming a pronounceable word, may be registered, provided that the combination consists of at least three letters/numbers; 3) additional protection for marks that are recognized as well-known in Kazakhstan, including those marks considered well-known pursuant to international agreement, has been introduced so that marks that are identical or similar to such well-known trademarks, regardless of the goods or services involved, may not be registered. |
