Ecuador - Procedure for Objection to Corporate Names On May 3, 1999, a resolution was issued to implement the provisions of the Ecuadorean Intellectual Property Law, according to which the owners of marks, commercial names or plant varieties registered in Ecuador or in a member country of the Andean Pact may object to the use of corporate names that contain signs identical or closely similar to theirs. Objections may be brought before the Industrial Property Office or Plant Varieties Office, in accordance with procedures similar to trademark opposition procedures, against corporate names that are registered by the Ecuadorean Bureaus of Companies and Banks. If the objection succeeds, the corporation must change its name or risk dissolution or liquidation. |
