Albania - Amendment of Trademark Provisions of Industrial Property Law

The 1994 Industrial Property Law of Albania was amended by Law No. 8477 dated April 22, 1999, resulting in the following principal changes:

1) decisions of the Board of Appeals are final in cases concerning absolute grounds for refusal and may not be further appealed;

2) owners of marks considered well-known in Albania, whether or not registered, may prevent use of a reproduction, imitation or translation of the well-known mark;

3) the assignment of a trademark shall have no effect unless it is recorded in the trademark register;

4) the period of non-use which renders a trademark registration vulnerable to cancellation has been decreased from 5 years to 3 years from the date of registration;

5) at the request of a trademark owner, Customs authorities may prevent the shipment of suspected infringing goods destined for import or export.
