United Kingdom - ELVIS PRESLEY Trademarks - Successful Opposition Upheld by Court of Appeal

In our December 1997 Newsletter (N.S. 189), we reported that the High Court upheld an opposition by Sid Shaw, the registered proprietor of the trademark ELVISLY YOURS, on the grounds of, inter alia, lack of distinctiveness of the marks ELVIS, ELVIS PRESLEY and the ELVIS Signature which had been applied for by Elvis Presley Enterprises Inc. Mr. Justice Laddie's decision in the High Court has now been upheld by the Court of Appeal which agreed that the opposed marks were inherently non-distinctive.
