Taiwan - Submission of Experimental Data on Appeal in Patent Cases
Hitherto if a patent application was rejected by the examiners and an appeal filed it was not possible to introduce additional experimental evidence during the appeal so as to bolster one's arguments for patentability. A recent decision of the Executive Yuan has, however, indicated a change in this practice so that such evidence may be admissible in the future.
