United States - Copyright Damages Section 504(c) of the Copyright Act permits the copyright owner
to recover statutory damages instead of actual damages and lost
profits. In a case of first impression, the Supreme Court in
Feltner v. Columbia Pictures Television Inc. decided unanimously that a copyright owner who elects to recover
statutory damages is entitled to a jury trial and is not limited
solely to a bench trial.
