Peru - New Legal Deposit Law

On December 21, 1997, a new Law entered into force which obligates all publishers, printers, producers or manufacturers of any and all printed works, sound recordings, computer programs, videotapes or any other information published or recorded for distribution in Peru to deposit copies of such materials with the National Library. Upon receipt, the National Library will issue a Certificate of Legal Deposit. Printers and publishers must imprint the phrase "Legal Deposit Duly Made", together with the corporate name and domicile, on all deposited works. Failure to comply with the provisions of the Law may result in fines. However, a subsequent decree, which entered into force on September 4, 1998, clarifies, inter alia, that the provisions of the Law only apply to material that is of Peruvian origin or that concerns Peru and that the obligation to include the phrase "Legal Deposit Duly Made" does not apply to materials imported into Peru.
