Mexico - Protection of Designs for Integrated Circuits By a decree that came into effect on January 1, 1998, Mexico now
provides intellectual property protection for the design of integrated
circuits. The main features of the decree are summarized below.
1. Protection is obtained by registering the design with the Industrial
Property Institute.
2. Protection is available for original circuit designs that have not been exploited anywhere in the world more than two years before the application for registration in Mexico. 3. Protection is for a period of 10 years from the date of filing the application for registration. 4. Marking of products embodying the design is required in order to enforce the right. Marking should be in the form of a letter "M" or a letter "T" in a circle accompanied by the name of the registrant. Furthermore it is an independent defense to an action for infringement of a registered right by way of sale, distribution and/or importation that the defendant was not aware that the product in question was a reproduction of a registered right that was produced without authorization of the registrant. 5. The new right is subject to the principle of international exhaustion of rights. |
