Iceland - New Trademark Act As reported in our December 1997 Newsletter (N.S. 189), a new Trademark Act entered into force in Iceland on June 1,
1997. We have now received an English translation of the new law,
and the principal changes effected by the new law are summarized
below:
Rights in a trademark have been broadened to include the ability
of the trademark owner to prevent use of another trademark if
there is a danger of confusion, including a likelihood of association
between the marks.
Marks for wines and spirits may not be registered if they refer to a geographical name and the product does not originate from the location in question. Previously applications were published for opposition and then granted registration. Under the new Act, applications will be registered and then published for opposition purposes. Appropriate provisions have been enacted to implement the Madrid Protocol system in Iceland. Applications for renewal of a trademark registration may be filed 6 months, as opposed to the previous 1 year, prior to expiration of the registration. |
