Trinidad and Tobago - Unfair Competition Law

We have been advised that an Unfair Competition Act was enacted, which contains several interesting features. The Act generally prohibits any act or practice, in the course of industrial or commercial activities, that is contrary to honest practices and specifically protects the appearance of a product, business identifiers, registered or unregistered trademarks, trade names, personality rights and well-known fictional characters from any act or practice that causes or is likely to cause either confusion or damage to their goodwill or reputation. The act also prohibits acts that mislead the public or discredit another's enterprise. Finally, the act expressly protects trade secrets.
