Malaysia - Trademark Regulations Amended to Introduce Protection for Service Marks

Effective December 1, 1997 and as a result of amendments to the Trade Marks Regulations, it is now possible to apply to register service marks in Malaysia, in accordance with the International Classification of Goods and Services. While the Service Classes 35 to 41 of the International Classification remain unchanged, Class 42 has been amended and three new service classes have been introduced, as follows:

Class Headings
Class 42
Scientific and technological services and research and design relating thereto; industrial analysis and research services; design and development of computer hardware and software; legal services
Class 43
Services for providing food and drink; temporary accommodation
Class 44
Medical services; veterinary services; hygienic and beauty care for human beings or animals; agriculture, horticulture and forestry services
Class 45
Personal and social services rendered by others to meet the needs of individuals.
Clients offering or proposing to offer services in Malaysia are urged to consider obtaining protection for their marks under the newly amended Regulations.
