Indonesia - Revision of Patent Law

A number of amendments to the Patent Law have been promulgated, primarily to comply with GATT-TRIPS. The most significant include the following.

1) The maximum term of a normal patent will be twenty years from the filing date as opposed to the previous fourteen-year term, and the maximum term of a "simple patent" (i.e. one for an invention that is new but not necessarily non-obvious) is increased from five years to ten years from the grant date;

2) Specific prohibitions on the patentability of plant and animal varieties have been repealed. However, patents will still not be granted for such inventions if they contravene public order or morality.
