Trinidad and Tobago - Trademark Act Amended

We have been advised that the Trademarks (Amendment) Act, 1996 was approved by Parliament and entered into force on August 16, 1996. However, since the Act contained certain errors, the implementing rules will not be promulgated until such errors are corrected. The principal changes effected by the amendments, which are intended to bring the Trademark Law into conformity with the TRIPS Agreement and the Trademark Law Treaty, are summarized below.

1) Registrations will be granted for a period of 10 years from the filing date and may be renewed for further 10-year periods.

2) Well-known trademarks will be protected.

3) The shapes of products and packaging will be protectable.

4) In cases of infringement, counterfeit goods may be seized and confiscated and criminal penalties enforced.
