Mexico - New Customs Regulations Providing for Seizure of Goods Bearing Infringing Trademarks

According to our sources new Customs Regulations have entered into effect to provide for the seizure of goods bearing infringing trademarks at the port of entry into Mexico.

Under the Regulations, a trademark owner must first obtain an order from either the Mexican Trademark Office or a court, pursuant to which the owner may then provide Customs with the relevant information concerning suspected shipments and request that the infringing products be detained at Customs and stored pending final disposition of the matter.
