France - Transmission of Television to Hotel Guest Rooms Covered by Copyright

In a case which has only recently been reported in English, Cable News Network v. S.A. Hotelier Novotel, the Paris Court of Appeal has held that Sections 132-20 and 122-2 of the French Intellectual Property Code, which between them require the payment of royalties to copyright owners for "communicating a work to the public", notably "by transmission of a broadcast work in a public place", extends to transmissions to hotel guest rooms. The court reasoned that "clients of the hotel taken together, while each privately occupying an individual room, nonetheless constitute a public to whom the CNN broadcasts were communicated".
