Canada - Design Protection The Canadian Patent Office has issued a notification relating to protection of designs, provisions of which are summarized below: 1) Electronic icons will be accepted as being registrable when embodied in an article as long as the icon is visible when the article is used for its intended purpose and as long as the features of the icon are not dictated solely by a utilitarian function of the article. 2) Where the novel features of an article consist of only a portion of that article, it is now possible to show in "stippled line" those portions of the article which do not provide novelty and are therefore not essential to the design in "stippled lines". 3) Guidelines have been issued clarifying how a design should be described in the written description. |
