Ukraine - Intellectual Property Laws Amended

The Law "On Amendments to Certain Legislative Acts of Ukraine Regarding Protection of Intellectual Property" has entered into effect. The Law specifically prohibits, inter alia, the unauthorized use of trademarks and service marks or labelling of goods, the copying of product shapes and packaging, the copying or direct reproduction of goods belonging to another owner and the unauthorized use of another's name.

The law also criminalizes "misappropriation" of, inter alia, inventions, discoveries, utility models, and designs.

In a related change, it has been provided that the valuation of intellectual property rights forming part of any investment in Ukraine must be expressed in hard currency, based on customary international practice, and confirmed by expert valuation in Ukraine.

Finally, Ukraine has now implemented provisions for protection of plant varieties.
