Taiwan - Monetary Controls on Payments for Patent and Know-How Licenses and for Franchise Fees Relaxed

It was necessary until August 1995 to obtain government approval for the licensing of patents and know-how and for franchising in Taiwan. As a result of amendments to the exchange control regulations and the trademark law, the following no longer require government approval:

1) the remittance of royalties and fees in foreign currencies;

2) the deduction for tax purposes of royalties and fees paid by a licensee;

3) the licensing of foreign-owned trademarks or service marks to a local licensee.
