Macao - New Trademark Law

We reported in our November 1995 Newsletter (N.S. 186) that a new Industrial Property Code entered into effect in Macao on June 1, 1995. On December 6, 1995, a new Decree entered into effect in Macao, modifying the previous law. We have been advised that the principal changes include the following:

1) registrations are now granted for a period of 7 years (instead of 10 years), beginning from the date of grant of the applications, and may be renewed for further 7 year periods;

2) it is no longer necessary to file Declarations of Intent to Use to support Macao trademark registrations; however, transitional provisions, which may affect registrations for which such Declarations were not filed, are still being prepared.
