Costa Rica - Law for the Promotion of Competitiveness and Effective Protection of Consumers

A law for the Promotion of Competitiveness and Effective Protection of Consumers has gone into effect in Costa Rica. Among the principal features of the law are the following:

1) the law prohibits acts that cause damage or threaten to cause damage to competitors by creating confusion or making false allegations;

2) the law prohibits the improper use, reproduction or imitation of trademarks, commercial names, advertising, packaging or any other means of identification that are the property of others;

3) a special Competitiveness Commission has been established which has the authority to investigate and punish unfair trade practices, provided that actions under the new law are initiated within six months from the date of the offense, the date of the last offense in the case of continuing offenses, or the date the injured party became aware of the offense, whichever is the later.
