Greece - New Consumer Protection Law Permits Use of Competitor's Trademark in Comparative Advertising

A new law on consumer protection entered into force on November 16, 1994. A principal feature of the new law permits the use of a competitor's trademark in comparative advertising, provided that the comparison fulfills the following criteria:
1) it is done in an objective manner;

2) it is not deceptive;

3) it does not cause confusion with the competitor's products or services;

4) it is not derogatory, defamatory or contemptuous; and

5) there is no intention to profit from the reputation in the trademark, or other distinctive characteristics, of the competitor.
