The Decree implementing Law No. 94-665 on the use of the French language was published on March 5, 1995, and entered into full effect as of August 5, 1995. The law mandates the use of the French language in connection with designations, offers, presentations, instructions, descriptions or guarantees of products or services; invoices and receipts; and international conferences.
Although the effects of this law on the use of trademarks is still uncertain, we have been advised that clarifications may be issued in the future. Meanwhile, we have been given to understand that distinctive trademarks in languages other than French may still be used and registered. However, slogans, expressions or information concerning such marks must be in the French language, or must be accompanied by a French translation in equal prominence. In addition, descriptive non-French elements which are contained in registered trademarks may only be used as a translation of the French version.
