Colombia - Trademark Office Declares Granted Registrations and Renewals Forfeited for Failure to Comply with Questionable Requirement Our sources in Colombia have recently reported that the Trademark Office has declared numerous granted registrations and renewals forfeited on the ground that the brief making payment of final Official Fees a matter of record was not filed in due time. We understand that, in these cases, payment of the Official Fees was made within the statutory three-month term, but that the brief recording such payment was not filed within the term. According to local counsel, the filing of such brief within a set term is not specifically provided for in the law and they have advised that the Trademark Office's interpretation of the statute is incorrect. Although in some cases appeals have been filed disputing the Trademark Office's position and representations are being made to the authorities at the highest levels, re-registration may be required in certain instances until the issue is finally resolved.
